After mistrial, a re-indictment — and more charges

Less than a month after his first trial ended in a mistrial, an Effingham County man has been re-indicted by a grand jury for the same offenses, with new charges added.

Ryan Daniel Herrington was indicted on three counts of aggravated assault, one count of kidnapping, three counts of possession of a knife or firearm during commission of certain crimes and one count of possession of methamphetamine for an April 20, 2009 incident. His latest indictment also tacks on one count each of trafficking in meth and criminal attempt to traffic in meth. Jennifer Counts was indicted along with Herrington.

Herrington had a two-day trial July 22-23 for his original charges, but a mistrial was declared at 11:30 a.m. July 23 by Judge Gates Peed.
Herrington had pled not guilty during an Oct. 14, 2009, arraignment.

In the original indictment, Herrington is alleged to have assaulted his victim with an intent to rape and also threatened to use the knife to kill her. He also is accused of hitting her repeatedly with a chair.
